Who you are dealing with

Using any part of this, free or paid, means these terms apply between you and us.

What this is

BrandOS scores a brand and turns the findings into a path you can work through. The scorecard and the ninety-day tracker are free. The detailed report, the brand strategy and the workbooks are each paid once. Watch, which re-runs the website audit on a schedule, is the only part that renews.

It is software you use yourself. Nobody at Turtle Labs does the branding work as part of it.

Scoring a brand

What the score is, and what it is not.

• The scorecard is automated and advisory. It reads the answers you give and, where you provide a website address, what a crawler can see of that site, and scores both against our own standards.
• A score is an opinion with a method behind it, not a valuation, an audit in any regulated sense, or a guarantee of any commercial outcome. Decisions you take from it stay yours.
• By submitting a website address you confirm that you own that site or are authorised to have it examined.
• BrandOS tells you what to change. It does not make the change. Naming, identity, collateral and campaigns are work done by Turtle Labs Studio and are scoped and quoted separately from any BrandOS subscription.

Auditing a website

What the audit is, and what it is not.

• By submitting an address you confirm that you own that site or are authorised to have it examined.
• The audit is automated and advisory. It measures what a crawler can see and scores it against our own standards. It is not a security assessment, a penetration test, or a certificate of compliance with any law or accessibility standard.
• A score is an opinion with a method behind it, not a guarantee. Decisions you take from it stay yours.
• We read public pages only, within the limits set out in the privacy notice, and we may refuse or slow down a request that looks automated.
• Starting a Watch authorises us to read that site repeatedly, on a schedule, for as long as the subscription runs. If that authority ends before the subscription does, stop the watch: the link to do it is in every email we send about it.

What this is not

It is not a branding agency, and a subscription buys no design, naming or writing.

It is not advice on which a legal, financial or regulatory decision should rest.

Where you want the work done rather than described, that is Turtle Labs Studio, and it is quoted against a brief.

Your account

You need a working email address and you must be eighteen or older.

Signing in works by a link sent to your address, so whoever can read that inbox can reach your account. Keep it secure, and tell us if you think somebody else has.

You do not need an account to run the free scorecard. One is only needed for the strategy path and the tracker.

You can close your account whenever you like.

What you write stays yours

Everything you write and every photograph you attach belongs to you. We claim no ownership of it.

We need permission to store and display it back to you, and that is the whole of the permission we need. We will not publish it, quote it, or use it as an example without asking you separately and specifically.

The material we wrote, the guides, the practices, the questions and the software, belongs to us. You may use it for yourself. You may not resell it or run it as your own programme without a written agreement.

Fair use

We may suspend an account doing any of that, and will say why.

• Do not use the forms to send mail to people who did not ask for it.
• Do not upload anything unlawful, or anything that is somebody else's to upload.
• Do not attempt to reach another person's account or our systems.
• Do not scrape the material or resell access to it.

Paying

In India the price on the page is the price you pay. We are not registered for GST, so nothing is added at checkout and nothing further is charged afterwards.

Outside India the sale is made through our merchant of record, which is required to collect the sales tax or VAT of the country you are buying from and adds it at checkout. The price shown is before that tax, so the total you are charged is higher, and the checkout shows the rate and the total before you pay.

Payment in India is taken by Razorpay. Outside India the sale is made by Lemon Squeezy acting as merchant of record, which means Lemon Squeezy is the seller for that transaction: it charges you, collects and remits the tax, and pays us.

In both cases your card or bank details are entered on their own page and are never seen by us or stored on our servers: what comes back to us is whether the payment succeeded, and a reference number.

A paid step is delivered as described on its page. Where a step is produced by a model rather than a person, the page says so before you pay.

What renews, and what does not

Watch is the only thing here that renews. It is billed monthly or yearly and keeps billing until you stop it.

Everything else is paid once: the brand strategy, the detailed audit report, the workbooks and a site built by Builder. Buying one of them does not start a subscription and nothing is taken from your card again.

The free scorecard and the ninety-day tracker cost nothing and are not billed at all.

Stopping Watch prevents the next renewal. The period already paid for runs to its end, and a yearly term is paid up front for the year.

Refunds

You have 14 days from buying to ask for a refund. Write to info@turtlelabs.co.in and say what you bought and when.

A refund we agree goes back to the method you paid with, within seven working days. Your bank may take a few days more to show it, which is outside our hands.

The scorecard is free, so there is nothing to refund for it. That is the point of it being free: you can find out whether this is worth paying for without paying for it.

Where the sale was made outside India by our merchant of record, a refund is processed by them and reaches you by the same route.

Nothing here removes a right the Consumer Protection Act gives you.

Availability

We will keep it running and we will not promise it never breaks. There is no uptime guarantee on a free tier.

If we discontinue something you have paid for and not yet received, we refund it.

Where we stand if something goes wrong

We are responsible for delivering what we described, and for handling your information as the privacy page sets out.

We are not responsible for decisions you take about your life, your work or your health after using this. The whole design of the product is that you draw the conclusion, and that cuts both ways.

The limit of what we owe you

Stated plainly, because a limit hidden in a long paragraph is a limit a court is entitled to ignore.

If we are liable to you for anything arising out of these terms or your use of this service, the most we owe you in total is the greater of the fees you paid us in the month before the claim arose, or Rs 5,000.

We are not liable for indirect or consequential loss: lost profit, lost revenue, lost opportunity, lost goodwill, or the cost of work you did in reliance on something here. Where information you stored with us is lost, our responsibility is to restore it from backup if we can, and not to compensate you for what it was worth to you.

• Death or personal injury caused by our negligence.
• Fraud, or any fraudulent misrepresentation by us.
• Our own wilful misconduct or gross negligence.
• Anything the Consumer Protection Act, the Digital Personal Data Protection Act, or any other law does not permit us to limit or exclude.

None of the limits above apply to the things in that list. They are not limited by this agreement and cannot be.

Turtle Labs currently trades as a sole proprietorship, which means there is no company between you and Aditya Bisen. The limit above exists so that an ordinary disagreement about a Rs 999 profile stays an ordinary disagreement. It is not there to avoid putting right something we got wrong, and the refund terms above are deliberately more generous than this clause requires.

If you have a complaint

Write to Aditya Bisen at grievance@turtlelabs.co.in. We acknowledge within forty-eight hours and resolve within thirty days, and we will tell you where it has got to rather than leaving you to ask.

If that does not settle it, you can take it to a consumer forum, or to the National Consumer Helpline on 1915. Where the complaint is about your information rather than your purchase, the Data Protection Board of India is the place after us.

Nothing in these terms takes away a right the Consumer Protection Act gives you.

Law

Indian law applies, and the courts at Nagpur, Maharashtra have jurisdiction.

If you are a consumer, that clause does not stop you bringing a complaint where the law says you may bring it, which is usually where you live or work.

Changes

We may change these. If a change matters we will say so here and write to you, and it applies from when we do, not backwards.
